8/28/2008 On the Road / Back to Beijing
So I have been back to Beijing for about ten days. To have a new start here, I spent five years and took a long journey. With the blessings and guidance of God, the road ahead of me becomes more and more straight. On the journey, I met several important people at each stop, my dear sister R.J. Chen, Mr. Fang, Auntie Luo, all of whom are willing to help me in one way or another, maybe I was/am lucky, or I have distinguished myself in some way, or there are always special arrangements in my life.
Once I thought something or someone were indispensible in my life, but they have disappeared or are disappearing. Once I thought I could save a lot of things and a lot of people, but it came out differently. Now I know more clearly what I am capable of and what I am not, regardless of the so-called ambition.
Every step will continue to record the story of An Inborn Miracle, and will be toward the Climax for the prelude is over. 6/24/2008 End to the Era of Gambling HeroThe era began from July 28, 2006, on which day I came to the United States for a series of gambles. The results were predestined but I still had to experience all the processes and procedures. The mature in personality comes from unexpected setbacks and hard times.
The missions in this period have been accomplished, and the special era in my life will technically end on July 22, 2008, on which day I will leave the United States. Before my leave, I still have to play an extra gamble, not for me, but for someone else.
Dream everything or dream nothing is basically the same, if you really know how to dream! 6/8/2008 《天堂口》/ 瞎掰几句在美国偶尔看看中文电影，这个看了很长时间了，今天瞎掰几句。
前面的情节还看得懂，后面的发展就有点不合逻辑了，以大刚前面那股劲那股势头，也不至于在后面能被马克那样一枪就干掉了。
大刚（刘烨），刘烨的演技还是那么出色，我一直觉得这个角色表现得很出色，所有的剧情发展没有什么可挑剔的，后面坐在沙发上被人一枪干掉怎么着就是看不明白。
阿峰（吴彦祖），这是一个我非常看不起的角色，去上海之前他已经有一个青梅竹马（李小璐）了，可是去了上海之后还要去主动的搭夜总会的那个露露（舒淇），这也不说了，这搭的方式也有点让我觉得有点不屑。打住，不说这个角色了。顺便感慨一句，我怎么就没有青竹马呢！
马克（张震），没怎么仔细观察他，后来他要冲到上海去杀大刚的时候，那一出演的有点忒假了，大刚的那些手下就等着那里当枪靶。这时马克说了一句话真的有点让人难以忍受，“这才叫杀手”这句话本身没有问题，可是背景是慢动作，这句话也说得软弱无力，就好像一个太监说了句“这才是男人”一样。
这几天看了一个电视剧，觉得还不错，有时间再写。 6/2/2008 Will Be In China Soon / 即将回到中国So I am telling that I will land on Shaanxi, China on this coming July 23, 2008. After spending about one month with my family and friends, I will start my new career in Beijing!

在忙碌了很多天之后，终于可以休闲这几天了，小记一下这些天的生活。
1，5.4演讲
大概4月底的某一天跟别人电话听说5.4有个支持北京奥运的集会。电话之后马上搜索了一下，发现活动从四月初就启动了，他们正在招聘志愿演讲者，这不正是我的特长吗？赶快给组织者发了邮件表示参与的积极性。虽然我已经是第五个报名者了（本来只要1-4名），但我还是希望自己能够做成这件事情。从4月30号到5月3号我根据组织者的要求不停的修改我的演讲稿，到我演讲的那一天，已经是第9版了（全文看上一篇日记）。本来被安排第一个演讲，后来因为有个17岁的ABC小朋友，我被安排到第二了。ABC小朋友虽然没有演讲经验，但是爱国心还是很明显的。我演讲之前好几个人跟我讲别紧张，我笑着说谢谢，心里想的是：连美国法院的口头辩论都玩过了，我岂能让自己的同胞和纽约民众失望呢？当我站在舞台上手握话筒的时候，我明显感觉到我甚至不是我之前想象的我，站在那里我就像obama在竞选总统一样，我有种煽动的欲望，从我停顿时他们的欢呼中，我知道我做到了。演讲完之后，有个人跟我讲他因为很累本来打算一个小时就回去了，因为觉得我的演讲很“inspiring”所以才继续留在了那里。还有个比较好玩的，因为主持人介绍了我来自陕西宝鸡，后来有个老爷爷专门走过来跟我讲，他参加中国人民解放军在1950年的时候行军经过宝鸡在那里住了一晚。啊哈哈……，我赶快答曰：宝鸡人民继续欢迎你来宝鸡，哈哈！
2，惬意的清晨
这几天醒的很早，先插叙一下为什么不上班的时候会起得早。上班的时候如果可以多睡几分钟我就会特别有满足感成就感，不上班的时候本来就可以多睡，就算多睡一会完全没有成就感！接着前面说，起床之后我就一身超休闲的打扮去社区操场旁散步，走在阳光斑驳的树荫下，惟有轻松惬意在心头。相形之下，旁边是那些面带焦急的匆匆行人；而我，此刻没有压力，也没有梦想，我甚至可以忘却男人的野心。
3，回国计划
只知道自己会在7月或者8月回国，但是并没有确切的日期。原因在于在美国还可能再发生一些事情，这些事情要等待一段时间才知道结果。总体而言，关于未来, 我处在一种平静的等待的状态，之所以平静是因为我对自己的未来有足够的决心和信心；之所以等待，是因为命运暂且还不能有自己掌控，我需要别人给我机会。

Today, I am taking this opportunity to send one message to our friends: we are a group of people who love peace and development. 今天，我借此机会向我们的朋友们传递一条信息：我们是一群爱好和平和发展的人们。
As observed by the world, China has made numerous achievements for the past fifty years and has become more and more influential in the world’s economic stage. However, we have no interest in becoming one of the world's superpowers. The reason is quite simple: from its establishment, the founding fathers of New China directed our focus to economic development. Moreover, after the end of the cold war, peace and development have become the world’s themes; and we are making active efforts to promote that peace and development of the world. 全世界都看到中国在过去的五十年内取得了不可胜数的成就，并且在国际经济舞台上变得日益有影响力。但是，我们无意成为世界上的超级强权。原因很简单，新中国的国父们指导我们把关注点放在经济发展上。更重要的是，在冷战结束之后，和平和发展已经成为世界的主题，而且我们一直在积极地推动世界和平和发展。
For this purpose, modern China has joined many international organizations who are contributing to the world’s peace and development. The international Olympics Committee has incorporated “promotion of peace” as one of its missions. Mr. Coubertin, the father of the modern Olympics Games, explained the Olympic flag in this way: the five rings represent the five continents of the world, and the six colors represent all nations on this planet. Dear Mr. Payne and Mr. Cafferty:

This is Zhenfeng Yan, a Chinese attorney admitted to the State of New York. I am writing in reference to the defamatory and racially discriminative remarks made by Mr. Jack Cafferty on April 9, 2008.
我叫闫振峰，是纽约州的一名华人律师，现就2008年4月9日Cafferty先生发表的诽谤性和种族歧视性的言论特出此函。
On the April 9, 2008 broadcast of CNN's The Situation Room, when asked to comment on the United States' relationship with China, Mr. Cafferty responded: “…We also are running hundreds of billions of dollars worth of trade deficits with them, as we continue to import their junk with the lead paint on them and the poisoned pet food and export, you know, jobs to places where you can pay workers a dollar a month to turn out the stuff that we're buying from Wal-Mart. So I think our relationship with China has certainly changed. I think they're basically the same bunch of goons and thugs they've been for the last 50 years.”
在2008年4月9日CNN电视台The Situation Room节目中，当被问及美国与中国的关系时，Cafferty先生答道：……我们一直进口他们的含铅的垃圾物品和有毒的宠物食品，导致我们每年跟他们（中国）有数千美元的贸易逆差；与此同时我们在向他们输出工作，在那里只需要向工人每个月付一美金，而这些工人生产出来的东西就是我们从Wal-Mart买的物品。所以我们跟中国的关系肯定已经变了。我想他们在过去的50多年间一直都是暴徒和无赖。
The above defamatory and racially discriminative remarks reflected Mr. Cafferty’s total ignorance of the progresses that we Chinese people and Chinese corporations have made for the last 50 years and have been recognized by people all over the world. The quality and reliability of “Made In China” products have made both Chinese manufacturers and their partners in the United States successful in business.
上述诽谤性和种族歧视性的言论反映出Cafferty先生完全忽略了中国人民和中国企业在过去50多年间所取得的成就，而这些成就已经为整个世界认可和肯定。中国产品的质量和可靠性不仅使中国的制造商取得了成功，而且他们在美国的合作伙伴取得了同样的成功。
However, Mr. Cafferty’s above malicious remarks, which aimed to defame and derogate products manufactured by Chinese corporations, have adversely affected the business of Chinese manufacturers and their U.S. distributors in expanding the market in the United States.
但是，Cafferty先生上述旨在诽谤和诋毁中国产品的恶毒言论已经对中国的制造商和他们在美国的合作伙伴在市场开拓上造成极大的负面影响（注：美国侵权行为法中，诽谤行为需要对企业在行业内的声誉或者生意造成影响）。
Moreover, Mr. Cafferty’s racially discriminative remarks on Chinese people has blatantly violated the prohibition on individual racial discrimination under the United States Constitution Amendment XIII and 42 U.S.C.A. § 1981. The conscience-shocking way in which Mr. Cafferty described Chinese people (“goons and thugs”) and Chinese products (“junk”) has materially impaired the abilities and opportunities of Chinese people, Chinese exporters and U.S. distributors of Chinese products to make contracts in the Unites States.
更严重的是，Cafferty先生的种族歧视言论公然违反了美国宪法第13修正案和美国法律42章1981条关于禁止个人种族歧视行为的规定。Cafferty先生描述中国人（暴徒和无赖）和中国产品（垃圾）的方式足以震惊人类的良知，也严重影响了中国人、中国出口商、美国分销中国产品的企业获得合同的权利和机会（注：禁止个人种族歧视的规定只适用于影响合同权利的情形，包括获得合同德权利和履行合同的能力等）。
The defamatory and racially discriminative conducts were provocative, offensive and will not be tolerated now or ever. It is terrible enough for Mr. Cafferty to spread such vicious, libelous and racially discriminative remarks which are untrue and are insults on every Chinese people and Chinese manufacturer. It is, however, another level of do so in live program via mass media.
上述诽谤性和种族歧视性的行为充斥着挑衅与诬蔑，无论过去、现在还是未来，我们都无法容忍。Cafferty发表这些违背事实情况且对中国人民和制招商充满侮辱的言论的行为简直是无耻之极，恶劣之极。而通过在大众传媒在直播节目中发表这样的言论简直将无耻和恶劣发挥到了登峰造极的地步。
The apology made by CNN on April 15, 2005 was apparently evasive and lacked the sincerity that people of both China and the United States have been looking for, and thus is unacceptable. CNN and Mr. Cafferty are hereby advised to do as follows as soon as you can: (i) Mr. Cafferty retrieves the defamatory and racially discriminative remarks made on April 9, 2008; (ii) CNN and Mr. Cafferty issue an apology letter showing the sincerity and earnestness that people of both China and United States have expected.
CNN在4月15日发表的道歉明显是在回避责任且缺乏中美人民所期待的真诚，因此不会被中美人民接受。我在此提醒CNN和Cafferty先生尽快采取下列行动：（1）Cafferty先生收回2008年4月9日发表的诽谤性和种族歧视性的言论；（2）CNN和Cafferty先生发表一封道歉书，在这封信中我希望看到中美人民所期待的真诚。
Shall CNN or Mr. Cafferty fail to follow the above suggestive actions, both CNN and Mr. Cafferty run the risk of being sued by provoked individuals and/or corporations that have been defamed and/or racially discriminated by Mr. Cafferty’s defamatory and racially discriminative remarks.
中国人民和中国企业已经被Cafferty的诽谤性和种族歧视性的言论激怒了。如果CNN和Cafferty先生未能及时采取上述建议性的行动，这些被诽谤和（或）遭受种族歧视的个人和（或）企业将随时到法院起诉CNN和Cafferty。

Finally, I decided not to apply for H1B visa and go back to China upon the expiration of my Optional Practice Training.
China is so big and full of opportunities, if I cannot accomplish something there, it is my fault.

其实在2月4号的时候我已经去过一次法庭了，不过那次出庭极为简单，几分钟就完事了。2月7号的出庭是个Pre-Trial Conference, 去之前我一点概念都没有，也不知道去了之后要干什么，因为我负责的案子也只能硬着头皮上了。去了之后就开始跟对方律师问有没有可能和解，跟客户谈了很长时间，他终于决定尝试一下。可能因为这个客户是个艺术家的原因，特别有灵感，每次到了法官面前的时候，开始他说他同意一些谈判条件，马上要结束的时候他就要提出一些新的要求。结果从早上10:00 一直到下午3:00 （中间有一小时的吃饭时间），经过五次谈判，四次休庭，五次法官会议之后，案件终于以和解方式而解决。这么长时间的出庭以及最终的处理结果真的出乎我的意料，或者说在我还没有反应过来的时候，我已经有了一次真正的出庭经历。
